SWMPs stopped being a legal requirement in England back in 2013 — but clients, BREEAM assessors and planning conditions ask for one anyway, because waste data now sits at the centre of a project's carbon and circularity story.
What is a Site Waste Management Plan?
A Site Waste Management Plan (SWMP) sets out how much waste a construction project expects to produce, how it will be minimised, and how what's left will be segregated, handled and disposed of — with a route to demonstrate what actually happened against that forecast. It's the waste equivalent of a Carbon Reduction Plan: a forecast, a set of actions, and a record of the real outcome.
Wait — didn't the legal requirement get scrapped?
Yes. The statutory duty to prepare a SWMP for projects over £300,000 (introduced in England in 2008) was revoked in December 2013 as part of a wider deregulation drive. If you're working purely to the letter of English law, there is no longer a standalone legal obligation to produce one.
In practice, that hasn't made SWMPs disappear — it's just moved the requirement from statute into contracts:
- BREEAM assessments award credits for a SWMP that forecasts, monitors and reports on waste, under the Resources category.
- Main contractors frequently require one from every subcontractor regardless of project value, as part of their own environmental management system.
- Planning conditions, particularly on larger developments, can still require a waste strategy or SWMP-equivalent document.
- The Duty of Care for waste (who's legally responsible for waste from production to final disposal) never went away — a SWMP is simply the easiest way to evidence you're meeting it.
What a good SWMP covers
- A waste forecast — estimated volumes by type (concrete, timber, plasterboard, metals, packaging, mixed) based on the project's design and programme.
- Minimisation measures — design decisions and procurement choices made specifically to reduce waste before it's generated, not just plans for dealing with it afterwards.
- On-site segregation — how waste streams are kept separate at the point of production, which drives recycling rates far more than sorting at the tip does.
- Carrier and site licences — confirmation that anyone removing waste holds a valid waste carrier licence, and that receiving sites are permitted for the waste type.
- Waste transfer documentation — a transfer note or hazardous waste consignment note for every load, which is the actual legal evidence of the Duty of Care being met.
- Actual vs forecast tracking — updating the plan through the project with what was really produced, not leaving the forecast as the final word.
The paperwork that actually protects you. If waste is later found fly-tipped or illegally disposed of, a properly completed waste transfer note showing who you gave it to is your primary defence under the Duty of Care. A SWMP without transfer notes behind every entry is a forecast, not evidence.
The metric that actually matters: diversion from landfill, not just "recycling rate"
"Recycling rate" gets quoted more often, but it only counts material that's genuinely recycled — it ignores waste that's incinerated with energy recovery, or reused directly, both of which are legitimately diverted from landfill even though neither is "recycling" in the strict sense. A site that reports a modest recycling rate but a high landfill diversion rate is often performing better than the headline recycling number suggests. Track both, and be specific in reports about which one you're quoting.
Common mistakes
- Writing the forecast and never returning to it. A SWMP produced at tender and never updated tells an assessor nothing about what actually happened.
- Mixing waste streams to save skip space. Every stream mixed together drags the recycling rate down and usually costs more in gate fees, not less.
- Missing transfer notes. The single most common gap found in a waste audit — loads that clearly left site with no corresponding paperwork.
- Reporting cost, not carbon. Waste cost data is useful for the finance team, but a compliance-facing SWMP needs the tonnage and disposal route behind it, since that's what carries the emissions figure.

Waste is routinely one of the largest Scope 3 categories on a construction project once materials themselves are accounted for, and it's directly measurable in a way a lot of Scope 3 isn't — every load has a weight and a disposal route. A SWMP that's actually being kept live, rather than written once and filed, becomes the same underlying record your PAS 2080 report and Carbon Reduction Plan draw their waste-related figures from — one set of site data, not a separate waste spreadsheet reconciled against the carbon report at the end of the job.
